1. Use of the Site and Eligibility
Your Service Animal LLC (“Company,” “we,” “YSA,” Your Service Animal,”“us,” or “our”) operates the Site at YourSupportAnimal.com. Our platform may help you connect with licensed or qualified mental health professionals (“Providers”) who can evaluate whether you are eligible for an Emotional Support Animal (“ESA”) letter.
- Age and Legal Capacity: You must be at least 18 years old and capable of forming a legally binding contract to use the Site. If you do not meet these criteria or do not consent to all Terms, do not use the Site.
- No International Guarantee: The Site and services are intended for use in the United States. We make no representation that our services are appropriate or available outside the U.S. Accessing them from outside the U.S. is at your own risk.
2. Mobile Messaging and Communications
If we provide SMS or mobile message services, your use of such features indicates consent to receive messages (including marketing) under applicable rates and terms. To opt out, reply “STOP” at any time. We are not liable for delayed or undelivered messages, nor for any charges from your wireless provider.
3. Limited Scope of Services; No Clinical Relationship
Our Site provides educational information and may facilitate introductions to Providers who can assess your eligibility for an ESA letter. However:
- No Emergency or Crisis Services: We do not offer emergency or crisis interventions. If you are experiencing an emergency, including thoughts of self-harm, call 911 or seek immediate in-person assistance.
- Not a Medical Provider: The Site does not offer medical, psychological, legal, or clinical services. Any information is general and should not be considered a diagnosis, treatment plan, or guaranteed outcome.
- No Doctor-Patient Relationship: Your use of the Site does not create a doctor-patient or therapist-patient relationship with the Company or any Provider you encounter. Any professional relationship is formed separately and directly with a Provider.
- Provider Autonomy: Providers retain complete professional responsibility for their assessments, advice, and services. We do not control their clinical decisions. You agree that we are not liable for any harm related to Provider advice or services.
4. Refund and Cancellation Policy
4.1 Denied Accommodation (Landlord or Housing Provider)
You may be eligible for a full refund of all Fees paid to Your Service Animal if your Emotional Support Animal (“ESA”) accommodation is denied by a landlord or property manager for reasons that specifically challenge the validity of your ESA letter. To qualify for a refund under this subsection, all of the following conditions must be met:
- Proof of Denial: You submit acceptable documentation (e.g., a dated letter or email) from the landlord or property manager clearly stating the denial of your ESA accommodation based on the letter’s validity.
- HUD Complaint: You file a formal complaint with the U.S. Department of Housing and Urban Development (“HUD”) regarding the denial and provide written proof of this filing to us at support@yourserviceanimal.com.
- Timely Submission: You send the HUD complaint proof and the denial documentation to support@yourserviceanimal.com within 60 days of the denial.
- Compliance: You provided accurate information throughout the process and attended each required appointment (evaluation, consultation, etc.).
If these criteria are met, we will process a full refund of the Fees you paid. Failure to satisfy any of these conditions will void your eligibility for a refund under this subsection.
4.2 Failure to Qualify (LMHP Declines to Issue an ESA Letter)
If the licensed mental health professional (“LMHP”) determines you do not qualify for an ESA letter, you may request a full refund by submitting the LMHP’s rejection letter (or other written denial) to support@yourserviceanimal.com within 30 days of the LMHP’s decision. Requests received after 30 days may be denied.
4.3 Limitations to Refund
Except as explicitly provided in Sections 10.1 and 10.2, no refunds will be issued. This includes, but is not limited to, the following scenarios:
- Failure to Schedule or Attend Appointments: If you do not schedule, miss, or cancel required appointments or consultations.
- Inaccurate or Incomplete Information: If the information you provided was false, misleading, or materially incomplete at any point in the process.
- Deadline Lapses: If you do not provide the necessary documentation or file a request for a refund within the timeframes stated in Sections 10.1 or 10.2.
- Express and Additional Services: Rush fees, additional documents, or amendments are subject to non-refundable conditions unless the documents are not accepted after you’ve properly filed a complaint.
4.4 Refund Process
Upon receiving your valid refund request and the required documentation under this Section, we will review the materials and, if approved, issue a refund to the original payment method used at purchase. We generally process refunds within 14 business days of approval. The exact timing of when the funds appear may depend on your financial institution.
